These Terms and Conditions apply to the use of the Book Of Memories websites (the “Website”) along with other services offered (collectively called the “Services”). Front Runner Professional (“Company,” “we,” “us,” or “our”) reserves the right, at our sole discretion, to change, update or alter (the “changes”) any part of these Terms and Conditions at any time for any reason. When changes happen, we’ll note the date they were last updated here. Changes will take effect no sooner than fourteen (14) days after posting; however, if changes relate to new features or legal requirements, those may go into effect immediately. If you continue using the Services after changes become active, it means you accept those updated Terms and Conditions.
Eligibility: If you’re under 18 years old, you can’t use the Services without permission. Users aged 13 to 17 may use them only with consent and supervision from a parent or guardian who’s at least 18 years old; that adult must also agree to these Terms and be responsible for your use of the Services. The Company can refuse service or suspend any Campaigns, Donations, or Services at any time without liability or explanation.
Definitions: Here “Campaign Organizers” means people raising money through campaigns called “Campaigns.” “Donors” are those giving money called “Donations.” All Campaign Organizers, Donors and visitors together are called “Users.” Also included in “Campaign Organizers” are individuals named as beneficiaries in Campaigns.
Services: We offer a platform (“Platform”) where Users can create Campaigns to collect Donations from Donors. Setting up Campaigns is free but we charge fees on each Donation for our services plus third-party payment processors’ fees. The Company may change or stop offering Services temporarily or permanently anytime without notice. You agree that we aren’t responsible for losses if Services change or stop unexpectedly. We’re not liable if data gets lost or isn’t saved correctly when using our Services. If you access via mobile device, your carrier might charge standard rates for data usage; some features might not work depending on your carrier or device restrictions. By using our Services on mobile devices, you consent to receive messages from us electronically regarding updates about us and related entities as well as information about how you use our Services.
Charitable Giving: Keep in mind that Campaigns are not official charities so Donations made aren’t tax-deductible donations. Some unaffiliated business partners process Donations charging processing fees besides our own Front Runner Professional Fee deducted from each Donation amount automatically. You understand Company is not itself a charity nor does it raise funds directly – it just helps process payments between Donors and Campaign Organizers.
Administrative Platform Only: Our role is just an administrative platform helping process payments between Donors and Campaign Organizers – we don’t take part in agreements between them personally nor act as brokers, agents or financial institutions here at all. We have no control over how organizers behave or what info they provide so we disclaim responsibility there completely including outcomes of campaigns which depend solely on organizers’ actions. Donors decide independently whether to give money based on their judgment alone; they should ask questions and do research before donating because all contributions come with risk since we don’t guarantee Donations will be used exactly as promised by organizers. We neither endorse nor guarantee quality/safety/legal aspects of campaigns; donors are responsible for deciding tax treatment related to their Donations themselves.
No Verification of Campaign Information: We do not check if info supplied by campaign creators is accurate nor promise donations will be spent according to what they say publicly. We take no responsibility verifying compliance with laws regarding donated funds usage either.
Your Registration Obligations: To access some parts of our Service you might need to register first. If registering voluntarily then provide true current details about yourself as requested during sign-up including real name & photo if required – especially important for campaign organizers who must represent themselves honestly. Your registration info is protected under our Privacy Policy rules too. Anyone younger than 13 cannot legally register/use Service at all while users under 18 need parental approval even if registered already. Some features require registering separately with third parties like payment handlers who have their own terms – although we sometimes assist this step we’re not responsible beyond facilitating connection & sharing info needed between parties involved here legally speaking only.
Public Display of Donations: When donating users choose whether donation info shows publicly visible on site OR shared privately only among beneficiaries behind scenes by ticking privacy box during donation steps accordingly. See Privacy Policy details explaining exactly what kind personal data collection happens through site usage scenarios clearly explained there too.
Payment of Donations: To donate someone needs give valid credit card details (VISA/MC/Discover/Am Ex) authorized properly before sending payment securely. Minimum amounts may apply while donations once completed cannot be refunded afterwards except specific exceptions outside system rules. Please keep account info current especially when billing cards expire/change. You authorize Company billing credit cards/payment methods repeatedly until cancellation happens explicitly within platform options anytime.
Fees: There’s no upfront fee charged by us just a cut taken out automatically from every Donation totaling four percent (4%) labeled “Front Runner Professional Fee.” On top comes additional Processing Fees paid out directly by third party payment systems below :
• US Users ONLY: Third party processor charges 2.9% plus $0.30 per donation made via VISA/Master Card/Discover cards OR 3.4% plus $0.30 per donation via American Express cards.
• CA Users ONLY : Third party processor charges same fees :2.9 % + $0.30 per donation for VISA/Master Card/Discover OR 3.4 % + $0.30 per Amex donation.
All Fees combined get taken directly off each Donation right away – meaning organizers withdraw less total than donors send originally due deductions. We reserve rights changing Fees anytime giving at least fourteen days prior public notice posted online usually unless immediate legal need arises instead. Using site past such Fee changes confirms acceptance thereof.
Indemnification : You agree protect hold harmless company plus affiliates/employees/officers/directors etc against losses damages expenses claims lawsuits arising from your Service usage including breaking terms violating others rights causing harm including death claims also waiving California Civil Code Section1542 protections stating: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE , WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR”. Similar waivers apply wherever else applicable depending residence jurisdiction.
DISCLAIMER OF REPRESENTATIONS AND WARRANTIES : YOU USE SERVICE ENTIRELY AT YOUR OWN RISK. COMPANY PROVIDES SERVICE ON AN ‘AS IS’ BASIS WITHOUT PROMISES ABOUT WORKING PERFECTLY OR MEETING YOUR EXPECTATIONS INCLUDING ACCURACY RELIABILITY SAFETY OR GUARANTEES THAT DONATIONS WILL REACH INTENDED CAMPAIGNS PROPERLY.
LIMITATION OF LIABILITY : COMPANY NOR AFFILIATES ARE LIABLE FOR ANY INDIRECT SPECIAL INCIDENTAL CONSEQUENTIAL DAMAGES INCLUDING LOST PROFITS GOODWILL DATA EVEN IF WARNED IN ADVANCE ARISING FROM SERVICE USAGE UNAUTHORIZED ACCESS THIRD PARTY CONDUCT ETC TOTAL LIABILITY LIMITED TO AMOUNT PAID IN LAST SIX MONTHS UP TO $100 MAXIMUM.
EXCLUSIONS : SOME PLACES MAY NOT ALLOW LIMITATIONS ABOVE SO THEY DON’T APPLY FULLY IF YOU DISLIKE TERMS YOUR ONLY OPTION IS STOP USING SERVICE.
DISPUTE RESOLUTION – ARBITRATION (PLEASE READ): ALL DISPUTES BETWEEN YOU AND COMPANY GO TO BINDING ARBITRATION EXCEPT SMALL CLAIMS COURT CASES PERMITTED.
